1. Introduction

(“we”, “us”, or “our”) regarding your use of the account service “Stay Foolish Account” and any related features, including but not limited to account settings and game-related functionality (collectively, the “Service”).

By signing in to or signing up for your Stay Foolish Account, or by otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Eligibility and Account Registration

To use the Service, you must:

• Be at least 13 years of age; and

You can create or access your Stay Foolish Account using an email address and password or via supported third-party login providers such as Google. You agree to provide accurate and up-to-date information when creating and maintaining your account.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Stay Foolish Account. You agree to:

• Not share your password or account with others;
• Use a strong and unique password; and
• Notify us promptly if you become aware of any unauthorized access or suspected security breach involving your account.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations;
• Attempt to gain unauthorized access to any part of the Service or related systems;
• Interfere with or disrupt the security, integrity, or performance of the Service;
• Use automated tools or scripts to excessively access or abuse the Service; or
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Game Data and Leaderboards

Your Stay Foolish Account may be used to store and manage data related to games that integrate with the Service, including:

• Gameplay Records;
• High Scores; and
• Other in-game profile information linked to your account.

Certain information, such as your Username and High Scores, may be displayed publicly in leaderboards or similar rankings within our games. By using the Service, you consent to this use and display of such information.

6. Intellectual Property

All content and materials provided through the Service, including but not limited to game assets, text, graphics, logos, and software, are owned by us or our licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. You agree not to:

• Copy, modify, distribute, or create derivative works based on the Service or its content, except as expressly permitted by us; or
• Use any part of the Service for commercial purposes without our prior written consent.

7. Third-Party Services

The Service may rely on or integrate with third-party services, such as:

• Google Services (such as Google OAuth for sign in); and
• Amazon Web Services (AWS) (such as Cognito, DynamoDB, API Gateway, Lambda).

Your use of third-party services may be subject to the terms and privacy policies of those third parties. We are not responsible for the content, availability, or practices of third-party services.

8. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at our discretion if:

• You violate these Terms or any applicable law;
• We reasonably believe your use of the Service may harm us, other users, or third parties; or
• We decide to discontinue the Service, in whole or in part.

You may stop using the Service at any time. You may also request deletion of your Stay Foolish Account in accordance with our Privacy Policy.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, regarding the Service, including but not limited to:

• Any warranties of merchantability, fitness for a particular purpose, or non-infringement; or
• Any guarantees that the Service will be uninterrupted, secure, or free from errors or defects.

10. Limitation of Liability

To the fullest extent permitted by law, Stay Foolish Capital PTE.LTD. and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, profits, or revenue, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising out of or related to the Service will be limited to the amount you have paid (if any) to use the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

11. Governing Law

These Terms and your use of the Service will be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts of Singapore for any disputes arising out of or relating to these Terms of Service.

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date at the bottom.

Your continued use of the Service after the updated Terms become effective means that you accept the changes.
